These Terms & Conditions (“Terms”) govern your use of Gegasoft’s Web Hosting Services and SaaS Solutions (CRM, POS, ERP and related software). By accessing or using our services, you agree to comply with these Terms. If you do not agree, please discontinue use immediately.

1. Eligibility

You must be at least 18 years old to use our services. By registering, you represent that you have the authority to bind yourself or the company you represent to these Terms.

2. Account Registration

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are fully responsible for all activities under your account.

3. Use of Services

You agree not to misuse our services. Prohibited uses include:

  • Hosting or distributing illegal, harmful, or malicious content.
  • Spamming, phishing, or distributing malware.
  • Attempting to disrupt or gain unauthorized access to servers, databases, or networks.
  • Reselling or sublicensing services without written consent.

4. SaaS Data & Hosting Content

  • You retain ownership of your SaaS business data (CRM, POS, ERP records) and hosted website content.
  • You grant us a license to store, back up, and transmit your data as necessary to provide services.
  • We are not responsible for data loss caused by your actions, third-party applications, or external attacks.

5. Payments & Billing

  • All fees are billed in advance according to your chosen plan (monthly, yearly, or custom).
  • Payments are non-refundable unless otherwise stated in a written agreement.
  • Failure to pay may result in suspension or termination of services.

6. Service Availability

We strive to provide 99.9% uptime for hosting and SaaS platforms. However, occasional downtime may occur due to maintenance, upgrades, or unforeseen technical issues. We are not liable for losses due to service interruptions.

7. Data Security

We implement industry-standard security measures. However, no system is completely secure. You are responsible for maintaining secure passwords and ensuring proper backups of critical data.

8. Suspension & Termination

We reserve the right to suspend or terminate your account if you violate these Terms, fail to pay invoices, or engage in activities harmful to our systems or reputation.

9. Limitation of Liability

To the fullest extent permitted by law, Gegasoft is not liable for any indirect, incidental, or consequential damages, including loss of data, profits, or business opportunities, arising from your use of our services.

10. Indemnification

You agree to indemnify and hold Gegasoft, its affiliates, and employees harmless from any claims, damages, or expenses resulting from your use of the services or violation of these Terms.

11. Third-Party Services

Our SaaS solutions may integrate with third-party applications (e.g., payment gateways, email services). Your use of these services is subject to their own terms and policies.

12. Modifications

We may update these Terms from time to time. Continued use of services after changes indicates acceptance of the revised Terms.

13. Governing Law
